Daughters Sue Mother for Access to Brother

We are currently acting for two adult sisters in the Federal Magistrates Court of Australia at Brisbane against their Mother to enable them to spend time with and communicate with their 17-year-old, mentally impaired, brother.

Our clients had not been able to spend time with and communicate with their brother for 1 – 2 years. Our clients were even denied telephone time with their brother.

Our clients had attempted, with the assistance of a psychologist and Family Dispute Resolution Counselling, to make arrangements but the Mother’s refused to commit to any arrangements.

An Application, to the Federal Magistrates Court of Australia exercising jurisdiction under the Family Law Act 1975, was filed on behalf of our clients and this came before the Court recently.

Our clients were fortunate that a Barrister, instructed by the solicitors for the Mother, took a very pragmatic view of the matter and we were able to negotiate Interim Orders to commence our client’s being able to spend time with their brother.

The matter is next before the Court in 2012.
